So, and I don't know why this hasn't been more widely reported online (it's news to me as of five minutes ago), but "we" won last summer. The sky didn't fall and nobody noticed because it's been business as usual, and that is no bad thing.

Predictably, there is still a push from the phone companies to mold the internet however they see fit, so how about taking just a little more time to ensure that this doesn't happen? , and .

Yep. I recently wrote up a nice letter for my representative on the issue, but for those of you playing devil's advocate on the side of the market, let me summarize how things went down for this whole problem to start.

In 1998, a court ruling classified cable modem internet services to be part one classification and part another. The names don't matter so much, but essentially, it was determined to be part telecommunications service (which is highly regulated for the common good, and is subject to common carrier regulations) and part information service (which is barely regulated at all).

In 2002 the FCC decided, hey, f**k that decision. They reclassified cable modem internet services to information services in a thinly veiled attempt to help out some of their media conglomerate buddies. That sounds really biased, but that's essentially how it is--whether or not they had the right to go against a court decision is something the courts themselves would have to decide. Common legal procedure is for courts to defer to the FCC, but an appealates court challanged their decision, essentially saying, "the courts can't defer to you on this--the decision happened four f**king years ago." the matter went all the way up to the supreme court.

What was the FCC's basis for the classifications change?

“Cable modem service is not itself and does not include an offering of telecommunications service to subscribers.”

so essentially they're trying to claim, "all you get for subscribing to an ISP is the path to the internet--the actual internet service isn't included, and is therefore not classified as a telecommunications service (i.e. not regulated)."

which is pure bulls**t.

Justice Scalia called them on that, likening it to dialing a pizza place and asking if they deliver, only to be told, "we don't deliver, but if you order from us, we'll bake you a pizza and bring it to your door." unfortunately, more than half the other judges apparently bought into it, creating the crisis we had earlier.

thankfully, savetheinternet.com's coalition got the word out to people, and people hammered the house and senate about the issue (which is good, because telecoms were lobbying the f**k out of both, and they had plenty of congressmen like Ted Stevens with hands deep in their pockets). a large company (AT&T?) agreed not to pull any bulls**t on the matter even though there's no legislation for it--yet. a new bill is being pushed through the senate just now.

what people don't realize is that the internet had net neutrality until 2002--and from then on, big businesses lobbied the f**k out of congress to seek some sign that they could pull s**t with their customers and not have congress backfire on them for doing it. this isn't fearmongering, they really do want websites to pay them for the bandwidth they take up, and no regulation means they can pull pretty much any underhanded crap they wish to. I know paragoonies and others fear the Great Satan of regulation, but in cases it is necessary, and this is one of them.

Tim Burners-Lee (the guy who created the WWW) also expressed concern that a free and open web is threatened by what companies like AOL-Time-Warner, Comcast and AT&T are pushing for. I'd trust him over armchair economists any day of the week.

Here's a way to solve the net neutrality issue - take that same graphic, and photoshop a big porn site logo in the highest-priced one. Knowing the internet, internet-users will be in uproar and not let it happen. I'm pretty much not even joking.

Internet users have been doing a lot already to prevent it from happening and it still is. That graphic, however, is just a mock-up and nobody will know what the phone companies decide to do until they do it. It might not be anything like this at all, really. But you do have to wonder why they're fighting so hard and putting so much money into maintaining the right to make such pricing plans possible.

I suspect that the real problem with no net neutrality will come more in the form of ISP's delivering certain sites (independent sites, competitor sites) with a much lower bandwidth. People would still get the content, so they wouldn't even realize they were being screwed (unless they were paying close attention). The graphic being shown above is a little far-fetched, though if consumers don't stand up and demand fair service, who knows, we might eventually get there.

What really burns me up are those commercials that deliberately try to confuse customers. I really hope people are smarter than to fall for .

The other bill that's been somewhat in the news and mostly not is the Protect-IP bill which would, basically, without hyperbolizing, wreck the internet for everyone forever in order to maybe block a few thieves from thieving.

Well today is "Blackout Day" in protest of SOPA/PIPA all across the internets. Sites like Reddit, Mozilla, Wikipedia, Google, and many others are censoring content or blocking everything entirely. Game companies like Mojang, Red 5, Epic, and Team Meat have also come out in protest of these bills. Everyone who makes a living through any kind of e-commerce or online presence is going to be affected by these bills. Just figured that I would bump this thread to get a discussion going again. Thoughts? Comments?

My local Congressman (NY District 2) has voiced his opposition, but both of my US Senators are still on the record as being FOR both bills. That upsets me greatly. New York has had a history of being a pretty liberal state, but to see both of my Senators for such a ridiculous bill is absurd.

I'll be speaking with my vote come election time.

Getting slightly off-topic, but I feel the Internet should be regulated in terms of INFRASTRUCTURE, not content. Remember the Amazon EC2 outage last year? The Internet has become such a vital part of the US (and world) economy, that should some router fail somewhere, it could bring things crashing down in a heartbeat. I recently found out that a good majority of US international traffic is routed through ONE location in lower Manhattan, imagine if that building had some sort of catastrophic failure? It would be disastrous.
